Judge Orders NDLEA to Produce Socialite KayCee Luxury After Spending 2 Weeks in Custody Without Charge

A Federal High Court in Lagos has ordered the National Drug Law Enforcement Agency (NDLEA) to produce detained social media personality and luxury businessman Afolabi Kazeem Michael, widely known as “KayCee Luxury,” over his continued detention without a formal court arraignment.

Presiding Judge, Justice Friday Ogazi, issued the directive following an ex parte application filed under the Fundamental Rights Enforcement Rules by his counsel, A. Labi-Lawal, SAN. In an affidavit deposed to by his father, Eric Afolabi, the defense argued that the socialite has been held in custody since his August 13 arrest at the Murtala Muhammed International Airport in Lagos without being formally informed of charges or presented before a competent court within the constitutionally mandated period.

The anti-narcotics agency had previously tied his arrest to a massive N39 billion operation involving the interception of 184.5kg of cocaine allegedly routed through a logistics pipeline. However, the defense maintained that a search of his Banana Island apartment yielded no incriminating items and challenged the agency’s right to detain him indefinitely.

In his substantive suit, the influencer is asking the court to grant him immediate release or bail, pointing to acute asthmatic health conditions that require specialized medical attention unavailable at the detention facility. He is also claiming N190 million in combined damages for alleged unlawful arrest, invasion of privacy, and the unauthorized circulation of photos and videos taken during his custody. Justice Ogazi directed the NDLEA to file its response within five days and adjourned the case until September 9 to hear the main application.
